This volume provides a forum for some of the best new philosophical work on law, by both senior and junior scholars from around the world. The chapters range widely over issues in general jurisprudence (the nature of law, adjudication, and legal reasoning); the philosophical foundations of specific areas of law (from criminal law to evidence to international law); the history of legal philosophy; and related philosophical topics that illuminate the problems of legal theory.

Purpose Although surrogate decision-making is prevalent in intensive care units and concerns with decision quality are well documented, little is known about how clinicians help family members understand the surrogate role. We investigated whether and how clinicians provide normative guidance to families regarding how to function as a surrogate. Subjects and methods We audiorecorded and transcribed 73 ICU family conferences in which clinicians anticipated discussing goals of care for incapacitated patients at high risk of death. We developed and applied a (...) coding framework to identify normative statements by clinicians regarding what considerations should guide surrogates’ decisions, including whether clinicians explained one or more of Buchanan and Brock’s three standard principles of SDM to family members. Results Clinicians made at least one statement about how to perform the surrogate role in 24 conferences ). We observed three general types of normative guidance provided to surrogates, with some conferences containing more than one type of guidance: counselling about one or more standard principles of SDM ; counselling surrogates to make decisions centred on the patient as a person, without specifying how to accomplish that ; and counselling surrogates to make decisions based on the family’s values. Conclusions Clinicians did not provide normative guidance about the surrogate role in two-thirds of family conferences for incapacitated patients at high risk for death. When they did, clinicians’ guidance was often incomplete and sometimes conflicted with standard principles of SDM. Future work is needed to understand whether providing explicit guidance on how to perform the surrogate role improves decision-making or mitigates surrogates’ psychological distress. (shrink)

International codes of ethics play an important role in guiding professional practice in developing countries. In the occupational health setting, codes developing by international agencies have substantial import on protecting working populations from harm. This is particularly so under globalisation which has transformed processes of production in fundamental ways across the globe. Currently much debate surrounds the significance of cross-cultural variation in mother-infant attachment. Is only one form of attachment “healthy,” or are different types of attachment adaptations to local socioecological conditions? Juvenile mortality rates have been promoted as important features of local environments that shape attachment, which in turn affects later reproductive strategies. To this we add fertility. Fertility changes the environment of a child by influencing the number of potential caregivers and competitors for care, and the cultural ethos regarding the (...) rights of children. Different combinations of fertility and mortality will likely give rise to different attachment forms, and only under one regime (low fertility and mortality) do we expect exclusivity in attachment. This paper contributes to our understanding of participation in the Eucharist by examining the swallow. The paper begins with a thick description of the swallow as act, as phenomenon, and as symbol. This description reveals the swallow’s interstitial nature, which is then examined for its implications on the meaning of participation in the sacrament. The paper then recommends approaches to the Eucharist for Catholics for whom swallowing is difficult or impossible. The paper finally incorporates these findings with the ex opere (...) operato doctrine, demonstrating participation as efficacious interaction. We believe that clinical ethics consultants (CECs) should offer advice, options, and recommendations to attending physicians and their teams. In their article in this issue of The Journal of Clinical Ethics, however, Kornfeld and Prager give CECs a somewhat different role. The CEC they describe may at times be more aptly understood as a medical interventionist who appropriates the roles of the attending physician and the medical team than as a traditional CEC. In this chapter, we examine the relationship between environmental political theory and the development of sustainability studies within US higher education. We assess the incorporation of environmental political theory authors in sustainability classrooms and the extent to which environmental political theory and sustainability studies classrooms engage in experiential, skills-based learning. We situate this pedagogy as an extension of the tradition of the liberal arts, especially as developed by John Dewey, and effectively, as citizenship skill development for democratic societies. To teach (...) twenty-first-century citizenship skills, we maintain, is to teach sustainability skills. This entails educating and empowering students to grapple intellectually and practically with the interdependent social, environmental, and economic challenges that define their current circumstances and future prospects. Environmental political theory can and should become more relevant to sustainability studies programs, primarily by strengthening its mission of engaged theory through the cultivation of experiential learning opportunities. This paper challenges the field to move beyond strategic philanthropy to a more encompassing concept of sustainable philanthropy. A brief history of philanthropic practices is presented, as well as a discussion of contemporary approaches to corporate philanthropy. The model of sustainable philanthropy developed here advocates integrating a triple bottom line approach with the strategic practice of corporate giving. It shifts the traditional model of powerful donor and a powerless recipient, to one where both donor and recipient must work harder to (...) identify a partner that shares their intrinsic values and objectives. The word 'archaic' derives from the Greek arkhaios, which in turn is related to the word archē, meaning 'principle', 'origin', or 'cause'; the notion of ecstasy, or ekstasis, implies standing outside or beyond oneself, a self-transcendence. How these two concepts are articulated and co-implicated constitutes the core question underlying this edited collection, which examines both the present day and antiquity in order to trace the insistent presence of the ecstatic amid the archaic. Presented in three parts, the contributors to this (...) diverse book take the concept of the archaic in an entirely new direction. Part I, 'Ecstasy and the psychological', covers topics including Jung, Freud, ancient psychotherapy, desire, and theatre. The collection offers a distinctive contextualisation of the dimension of the archaic in relation to the ecstatic experience.
